1. Introduction

These Terms and Conditions (“Terms”) govern the use of the website mineralbids.com (the “Website”), operated by MineralBids, a sole proprietorship established in Greece (ΑΦΜ: 133466759) (“MineralBids”, “we”, “us”, “our”).

By accessing or using the Website, creating an account, listing items, placing bids, or purchasing products, you agree to be legally bound by these Terms. If you do not agree, you must not use the Website.

2. Platform Role & Nature of the Marketplace

MineralBids operates an online auction marketplace platform.

MineralBids is not the seller of items listed on the Website.
Sellers are independent third parties.
MineralBids acts solely as an intermediary and service provider, offering technical tools that enable sellers and buyers to transact.
The contract of sale is formed directly between buyer and seller.

MineralBids is not a party to the sales contract.

3. Eligibility & Age Requirement

Use of the Website and participation in auctions is strictly limited to persons aged 18 years or older.
By registering, bidding, or purchasing, you declare and warrant that you are at least 18 years old.
Accounts found to belong to minors may be suspended or terminated, and bids placed by minors may be voided.

4. Accounts & Registration

Users may register as buyers, sellers, or both.

You are responsible for:

Providing accurate and complete information
Maintaining the confidentiality of your login credentials
All activity occurring under your account

MineralBids may suspend or terminate accounts that violate these Terms or applicable law.

5. Auctions & Bidding Rules

All bids are binding.
Once placed, bids cannot be withdrawn, except where required by law.
Sellers may set reserve prices, starting prices, and auction durations.
Auction end times are final unless extended automatically according to platform rules.
MineralBids is not responsible for bidding errors caused by user input, connectivity issues, or device malfunction.

6. Seller Obligations

Sellers are solely and fully responsible for:

The accuracy of item descriptions, images, weights, dimensions, condition, and authenticity
The legality of offering the item for sale under the laws of their country
Compliance with export, import, customs, environmental, and cultural property laws
Proper and secure packaging and shipment
Any warranties, guarantees, or representations they provide
Clearly stating their own terms where applicable (e.g. shipping methods, handling times)

MineralBids does not inspect, verify, or authenticate items listed for sale.

7. Buyer Responsibilities

Buyers acknowledge that:

They bid and purchase at their own responsibility
Item descriptions are provided by sellers, not MineralBids
They are responsible for compliance with import laws, customs duties, and local regulations

8. Payments

Payments are processed via PayPal.

Depending on seller configuration:

Payments may be automatically split between seller and MineralBids’ commission, or
Payments may be received by MineralBids and later paid out to the seller, minus commission

MineralBids is not responsible for PayPal account issues, limitations, or disputes.

9. Fees, Commission & VAT / Tax Treatment

9.1 Commission

MineralBids charges sellers a commission for providing marketplace services.
The commission is separate from the product price and is calculated on top of the seller’s listed price.

9.2 Seller Taxes

Sellers are solely responsible for VAT, sales tax, duties, and any other taxes applicable to their sales.
Sellers must include their own applicable taxes in the item price where required.
MineralBids bears no responsibility for seller tax compliance.

9.3 Invoicing by MineralBids

Depending on seller status:

a) Businesses providing a valid VAT number (verifiable via VIES) or verifiable proof of business establishment outside Greece

MineralBids issues a Service Provision Invoice (Τιμολόγιο Παροχής Υπηρεσιών)
VAT treatment follows applicable EU rules (including reverse charge where applicable)

b) Greek businesses

MineralBids issues a Service Provision Invoice (Τιμολόγιο Παροχής Υπηρεσιών)
Greek VAT applies according to law

c) Individuals (non-business sellers)

MineralBids issues a Proof of Service Provision (Απόδειξη Παροχής Υπηρεσιών)
24% VAT is applied on the commission

VAT, where applicable, is calculated on top of the commission.

MineralBids does not provide tax advice. Sellers remain responsible for their own tax declarations.

10. Refunds, Returns & Disputes

Refunds due to seller fault (e.g. misrepresentation, improper packaging, damaged items) are the sole responsibility of the seller.
MineralBids does not issue refunds on behalf of sellers.
MineralBids retains its commission in such cases.
Buyers must contact the seller directly to resolve disputes.

MineralBids may assist procedurally but bears no financial liability.

11. Intellectual Property

All Website content, software, branding, and design are the property of MineralBids or its licensors.
Users may not copy, reproduce, or exploit content without permission.

12. Limitation of Liability

To the maximum extent permitted by law:

MineralBids is not liable for losses arising from seller conduct, item quality, shipping, or legality
MineralBids does not guarantee uninterrupted or error-free operation
MineralBids’ liability is limited to the service fee paid to it, where applicable

13. Suspension & Termination

MineralBids may suspend or terminate access where:

These Terms are violated
Illegal activity is suspected
Required by law or authorities

14. Changes to Terms

MineralBids may update these Terms at any time. Continued use of the Website constitutes acceptance of the updated Terms.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of Greece.
Any disputes shall be subject to the exclusive jurisdiction of Greek courts.
